Community Rules & Expectations

Per the Community Bylaws, additional rules and general expectations in may be administered by Board of Directors separate from the Community Bylaws based upon commonly occurring issues and community needs.  These items are typically reviewed on a yearly basis and are subject to change following Board of Directors majority vote.

(Refer to Article XI; Section 16 of the Community Bylaws for additional details behind Community Rules and Regulations)

The following is a list of active rules and minimum community expectations to be followed as members of the Millwood Village Association.  If you have questions on these rules or need additional clarifications, please feel free to reach out to the Board of Directors via email at millwoodvillage@gmail.com.

Home Repair

All homes shall be in good repair, to include all aspects of the exterior of the home (what individuals do inside the home is private and is your business)

  • All homes are to be painted and/or sided in a color that is harmonious with the subdivision -- prior to painting / siding, color choices must be approved by the Board in writing, in advance of any work being started

  • Roofs, gutters, sump pump lines to main sewer, windows, garage and front doors, exterior lighting, etc. are to be present and in good repair (may extend to other areas of the exterior of the home that may not be listed here)

Landscaping

All landscaping will be harmonious, complimentary, and dignified

  • Weed free lawns, cut on a regular basis

  • Watered on a constant basis as needed

  • Bushes and trees trimmed in scale with the home

  • Lawn to be edged and weed free -- all clippings removed (not blown and left in the street) -- driveway separations to be grass and weed free

  • Flower beds / bushes to be grass and weed free

  • Curb Edges (where street and sidewalk curb meet) to be weed and grass free (sweep after cutting the grass as needed)

Trees

No trees or bush cover shall be cut/removed from the general or limited commons area without written permission from the Board.  Should this occur without written permission, the owner responsible for the removal will be responsible to replace trees of a specific type and size at their own expense within a given timeframe to be advised by the board.

  • Association is responsible for the cost of cutting/trimming trees within the general common element

  • Homeowner is responsible for cost of tree trimming and/or removal within the limits of ownership and the limited common element

  • Trees/Homeowner Area of Responsibility

    • ​Per the bylaws, the following is how to determine if a tree is the responsibility of the homeowner or the Association:​​

      • Each unit has a 25 ft. Limited Commons Element (or easement) at the front of their lot, as well as a 25 ft. Limited Commons Element (or easement) at the back of their lot​

      • All units have a specific area designated as the Limits of Ownership (Lot Size -- This is the area where the house has been built)

    • Any tree within the defined area is the homeowner's responsibility.  

    • Using Unit 48 as an example:

      • The 25 ft. at the front and rear are Limited Common Elements​

      • The unit's Limits of Ownership is 59 ft.

      • Any tree within the total 109 ft length of the property (25'+59'+25' = 109') is Unit 48's responsibility

General Commons

General Commons Areas (Front, Side, and Center) are areas that are not to be used as a dumping ground for grass, leaves, logs, branches, limbs, equipment, etc.

Lamp Posts

Lamp posts are to be lit at night and in working order at all times of the year.  Millwood does not have typical street lights, so these lights are important for the safety of all those within the community.

Garbage Cans / Recycle Bins

City-Provided Garbage Cans and Recycle bins are to be stored either behind the house or inside of the garage. Any additional bins or receptacles should also be stored in these locations. Placement out in front or on the sides of the unit are not acceptable storage locations.

Wood Piles

Wood Piles for Personal Use are permitted per the following guidelines:

  • May not exceed one face cord (4ft x 8ft x 16in)

  • May only contain cut fireplace wood - No boards, Tree Branches, etc.

  • To be located at the back of the property or on the side of the home, but NOT within the General Commons area should a property back one of the General Commons areas.

Side of House

No items shall be stored or placed on the sides of Millwood homes.   This includes, but is not limited to: ladders, grills, boxes, furniture, pallets, storage containers, etc.  Wood Piles and Garden Hose storage items do not fall under this condition and are permitted per aforementioned criteria.

Classification of what constitutes the side of the home is the visible area as seen from the front of the property facing the rear.   

Fences

Fences are not allowed as part of Millwood Village, with the exception of those required per State Law to accompany in-ground swimming pools.

The board observes the following definitions when pertaining to the subject of fences:  

"Any barrier, railing, or other upright structure, typically of wood or wire, enclosing an area of ground to mark a boundary, control access, or prevent escape."

Sheds

No sheds or other external separated dwellings are allowed to be added to Units or in the Limited Commons element.  Clarity on this item can be found in Article VI; Section 3 of the Community Bylaws.

Vehicles

No vehicles other than cars/trucks designed and used for primarily for personal transportation may be parked or stored in any portion of the neighborhood

  • All vehicles should be parked in garages to the extent possible -- garage doors to be kept closed when not in active use

  • No non-working /non-operable vehicles shall be parked or stored in front of the home or in the driveway >> must be stored in the garage

  • All vehicles shall be moved from the street when an accumulation of snow of 2 inches or more is predicted

  • Regular maintenance is allowed to maintain personal vehicles in a running state in either one’s garage or on one’s driveway property. All maintenance is to be completed and cleaned up each evening. No car parts or tools are allowed to be left out unattended in front of one’s property when not actively performing said maintenance

Sewer Lines

The Association is responsible for the main sewer lines -- the homeowner is responsible for the lines going from the house to the main sewer line (incl. Sump Lines)

Dues / Fees

The Association quarterly dues are currently $175 (Total of $700 per year).  This amount is predicated upon the Treasurer's Annual Budget Report, Expenditures Log,  and Forecast Predictions for both near and long term future planning (and is subject to periodic change on an annual basis)..
